The unholy, gruesome demeanor of Prosecutor Ashton during his delivery of the rebuttal to the defenses' motion in court today should be proof enough of the 'bad faith' tactics of the state.
He was inarticulate and sloppy and resorted to the type of salacious sensationalism that I imagined he was capable of, but never thought his co-council would let him lower himself to in open court.
He is in full throttle panic mode and has proven today that he is no match for the defense.
I find it hard to believe he passed the bar. He certainly doesn't seem to have a full grasp of matters of law, let alone a search for the truth. He is hell bent on revenge, and his ego was blatantly baring itself for every one's amusement. The man is a joke.
He seemed to be completely unfamiliar with the cases that Andrea Lyon addressed. Mr. Ashton was so busy smirking and whispering like a seventh grader while Ms Lyons was speaking, it's a wonder he even recognized it was his turn. When he stood up to approach the dais, the judge very generously mentioned the case that was being discussed.
I really hope the judge noticed the impropriety here. This guy is the polar opposite of what one should expect a distinguished member of the bar to be.
He's crude and intellectually challenged. I guess you could say he's 'special'.

So sorry, but I wanted to make sure you and I were infact watching the same proceedings... I felt Ashton was calculated,clearly articulate, and to the point. All I seemed to hear from the deffense was Baez's inability to mute the mic and Lyons on and on drone about how the state is trying to "kill" her client! What about what Casey did when she KILLED Caylee?

I only have 1 negative comment about the pros. And that he approached it like an opening statement - that was wrong IMO. I know he was trying to state his reasoning, but going into great detail about how he thought Caylee died should be saved for the trial. He may have just tainted a huge population of jury prospects. It doesn't change how I feel about the case, but I do think there are errors on both sides of the table.
I have to agree with your appraisal of Mr. Ashton.
He is childish. Why is no one crying about his use of drama at that moment? Where is the concern about his not having cases to backup his wanting the death penalty? The drama was great for the press but it didn't do a thing for me. I also thought the press behavior outside the courtroom was more National Inquirer than a local press.
I seriously doubt that we were watching the same trial, but thank you for submitting my post! :)
If this article is even close to correct.. why did Stan Strickland say "good lawyering" at the end? I personally think Mr. Ashton did an excellent job and gave Casey a little peek into the future of hearings to come.
I think Judge Strickland was referring to the legal expert from whom the 'good lawyering' originated...Andrea Lyons.
I had a very different take on Ashton's arguments . I think the defense forced the prosecution to spell out the reasons that this is a DP case. That the state at this point was forced to say, OK here it is. Don't forget the aggravating circumstances that the defense wanted to throw out are the very same ones he was forced to defend. I think Strickland can't just give Lyon the floor to argue her side without doing the same for the state. The prosecution has been low key about the DP in court up until this point.
In any case, I think the arguments about the DP had more to do with the appellate process than the trial at hand. JMO
The Defense forced the prosecution's hand. Andrea Lyon was arguing nonsensical points bringing in statutes from other states, basically trying to get Strickland to declare FL death penalty unconstitutional (remember Strickland's 'reinvent the wheel' comment). This is all part of her shotgun strategy. Ashton cut to the heart of the matter and iterated why this is a death penalty case. I don't know why people are so upset with him.
He stood up for Caylee with a powerful and passionate voice. Casey cried for herself, not Caylee - she had 31 days to look for Caylee and she wasn't crying during interviews with law enforcement. I think she's finally beginning to see she's going down for the murder.
I have to disagree with you take on Friday's hearing. I felt that Asst. State Atty Ashton presented a very clear and concise argument which included a graphic description of the State's theory of Caylee's death. This is only a small speck of what will take place once the Trial gets underway.
Casey & her parents will be shown autopsy photos (most likely poster size) and the jurors will be viewing the same photos.
Reality is setting in now.....and they can no longer DENY what they already know as FACT.
IMO The Duct Tape is the murder weapon.

What do you mean Ashton did not cite case law for his reasoning for asking for the death penalty? He did cite the law. Anyone in the state of Florida who is charged with First Degree murder is eligible for the death penalty. There does not have to be special circumstances or aggravating factors to ask for the death penalty to be sought in a First degree murder case in the state of Florida contrary to what Andra lyons was trying to assert.Ashton did not need to cite case law he cited the state law. If anyone does not know the law and was inarticulate it was Andrea Lyons. Most of Andrea Lyons argument was based on studies and not case law or state law. I'm pretty confident that Ashton knows Florida law better than Andrea lyons. If she wanted an aggravating factor which the prosecution does not have to supply, she got one of many on Friday. As the saying goes. Be careful what you ask for.

I'm just glad that there's one side that remembers the reason they're all in court ..Caylee.. that's what this is about. A small child who died while in her Mother's care, probably by her Mother's hands. I understand Ms Lyon's points but they did not apply in this case or in the state of Florida. Ms Lyons is not about Caylee and it saddens me to see how little Caylee matters to those who sit on the defense side of the court.
Caylee is the reason for these procedings, Caylee is the only victim. Casey had choices once, she chose to end her daughter's life. No more choices for Casey, if she and her team do not like what they hear...tough noogies. Caylee needs justice and Mr Ashton is bring it for her.
I thought that Ashton did a fine job. I doubt that any of the defense's motions will be granted. It will be up to the jury to decide whether the death penalty applies to this case.
IMO Ashton did a stupendous job of presenting why the State wants the DP for Casey. If the Anthony's couldn't listen to Ashton's description of Caylee's death, they they most certainly have their heads buried in the sand.
The trial will be much, much worse for them. That is the absolute TRUTH. Something they know nothing about. Thank God the State is the voice for Caylee because her own family has NEVER been her voice. Their ownly mission was to hawk as many of her pictures and videos
to add Blood Money to their bank accounts.

Ashton relied on emotion to sway the Judge. He also knew that it would feed the frenzy of those who have been poisoned by the tabloid media. If this is what we can expect during trial, it only proves that Ashton knows he has no case and hasn't got the skills to argue with a true lawyer.
I have been to your site a few times before just to read other opinions. I admire your willingness to use your 1st ammendment right to speak your mind and stand up for your beliefs no matter what you read to the contrary in the press. I have read your profile and it could be mine (your favorite music, books, etc.). We share a lot of similar interests. Unfortunately, I disagree with you on the primary issue, I believe Casey is guilty. However, I believe you would be a worthy adversary if we were to debate the issue. I am trying to read back through some of your early posts to answer some questions I would like to ask you like how do you explain the smell in the car? That can not be tampered with by law enforcement. I apologize if this is off topic or if you have covered this somewhere in your past blog posts and this is repetitive but like I said I am still trying to read through your past posts. I look forward to reading your theory about my question. Thanks for posting this.
I think what needs to be pointed out here also is, that this was only an argument as to why the death penalty can be ASKED for. This was not the time we were to expect the facts of the case to be put out as to IF she should actually be given the death penalty. So, with that in mind, Mr Ashton, thankfully for Casey, did all he needed to do. That was to just explain his position as to why the state can ASK for it. He did a fine job for that purpose and obviously Judge Strickland agreed, as he ruled in their favor. Enough said!

You have the 31 days wrong in your current post. Casey herself told Lee she had not seen Caylee in 31 days. Casey told LE she dropped Caylee off on June 9th & then changed it to June 16th. Caseys phones were checked & there wasn't any phonecalls made to the phantom nanny, not one!
I was sceptical coming into this case & it wasn't the 31 days that convinced me. It was the phonecall Casey said she receieved from Caylee July 24th that cinched it for me.
Also, I believe Caseys grandmother when she said "Casey hated Cindy more then she loved Caylee". That summed it all up for me.
Doesnt the words "intellectually challenged" describe Jose Biaz much more so than the prosecutor. Between Casey`s parents and her lawyers, I think she will sit in jail the rest of her life, which is definitely what she deserves
I think Ashton did a superb job. He was kind enough to point out the defense was only giving their opinions and not stating the facts, ouch! Fact is Caylee died by chemical OR physical restraint. Which one was it?
